Supertech hasn't 'handed over' 200 flats, no OC obtained: Homebuyers

People who have bought homes at Supertech's Romano site here refuted the builder's claim that 200 flats were handed over to them last week, saying that only "three or four" families were given the keys. Even these flats were handed over without the builders obtaining the "occupancy certificate", the homebuyers' association said.

In a statement on January 25, Supertech had said it "handed over as many as 200 flats in its Romano project to home buyers today".

Supertech Romano Homebuyers' Association, however, said the builders' claim is "untrue" and the project, which is delayed by over three years, is "far from livable".

Confronted with the homebuyers' rejoinder, a Supertech spokesperson said on January 28 that keys were handed over to 20 buyers.

But all flats in Tower B2 are ready and other homebuyers have been sent a communication offering possession, the builders claimed.

"Not everyone came on January 25 but we had invited all buyers on Tower B2 to take possession of their homes," the spokesperson claimed.

The spokesperson said the group has "applied for" the occupancy certificate for Tower B2 of its project located in Sector 118.

Earlier, the homebuyers' statement said, "There are only 150 units in Tower B2 and not 200 as reported and on January 25 keys were given to only 3-4 buyers and not to 200 as reported."

"Neither the occupancy certificate nor the completion certificate has been obtained for the project or the units offered for possession," it added.

The association said the promised infrastructure like a club, a swimming pool, children's play area and jogging track are not yet available.

It alleged that Supertech has also backed out from its commitment to make pre-EMI payments to subvention buyers.

"The project is delayed by over three years and the company is not pursuing it even now. Mere 15-20 labourers can be seen on the site of such a huge size," the homebuyers' association claimed.

NGT slaps Rs 68.51 lakh penalty on Ambience Developers

The National Green Tribunal has slapped a penalty of Rs 68.51 lakh on a builder for construction in the green area in a housing complex in Gurgaon in violation of environmental laws. A bench headed by NGT Chairperson Justice Adarsh Kumar Goel asked the builder to deposit Rs 68,51,250 to the Central Pollution Control Board within a month.

The tribunal said any approval granted without considering the impact on the environmental rights of persons to whom the flats were allotted is against the Sustainable Development and Precautionary Principles required to be enforced by it.

"Powers of regulatory authorities was required to be exercised in accordance with these principles. Environmental Impact Assessment procedure was required to be duly followed. The Deed of Declaration filed by the builder in 2009 showed the area to be an open area which was the basis on which the flats were allotted prior to 2010," the bench said.

The NGT said, "Out of 10.98 acre land which was meant for the project in question, only 7.93 acre land was used and remaining 3.05 acre land, which was open area, was converted into covered area for a commercial tower, irreversibly taking away the rights to ecological services of the persons to whom the flats were allotted."

The order came after perusing a report filed by the Ministry of Environment, and Forests and Climate Change (MoEF) making an assessment of Rs 68,51,250 to be paid as environmental compensation.

Advocate Balendu Shekhar appeared for the MoEF in the case.

The tribunal was hearing a plea filed by Gurgaon residents Anil Uppal and others seeking action against the builder for construction on the green/open area in a housing complex.

According to the applicants, Ambience Lagoon Apartment was a housing complex at National Highway No. 8, Gurgaon, Haryana developed by Respondent No. 6, Ambience Developers & Infrastructure Private Limited.

"Open areas in the colony are shrinking. Groundwater extraction was excessive. Air quality was getting deteriorated. The builder had undertaken construction on designed open spaces, blocking fresh air and sunlight. The approved zoning plans required maintaining at least 15 percent of the total area as open space. National Building Code of India, 2005 also requires minimum horizontal space between existing building and the new building," the petitioners said.

Gurugram: Nine properties sealed for unpaid property tax

MCG on January 14 sealed nine properties for non-payment of dues, following a directive from the chief minister to recover pending property tax that amounts to crores of rupees. Among major properties that were sealed were Universal Business Park and Today Homes.

On December 9, Chief Minister Manohar Lal Khattar had directed the civic commissioner to recover dues from realtors who had defaulted on more than Rs 20 lakh each. But even after a month, only 13 of 253 major defaulters have deposited their dues.

MCG Commissioner Vinay Pratap Singh said Universal Business Park in Sector 66 and Today Homes in Sector 73 owed the civic body Rs 2.6 crore and Rs 27 lakh, respectively. Both these properties are in Zone 4.

In Zone 1, two properties — one owned by Reliance Group in Sector 88 with dues worth Rs 47 lakh and SK Electricals which owes Rs 59 lakh — were sealed by Zonal Taxation Officer Vijay Kapoor.

Renault Service on Old Delhi Road with Rs 39 lakh dues and Ansal Triangle in Palam Vihar with Rs 25 lakh dues were sealed in Zone 2. Similarly, three farmhouses were sealed in Gwal Pahari and Ghata areas of Zone 3. They have pending taxes of around Rs 26 lakh, Rs 24 lakh and Rs 27 lakh, respectively.

Singh said all joint commissioners of the zones concerned had been directed to take up the matter on a priority basis and organise a special drive to collect the dues before January 31.

"The additional municipal commissioner will monitor the recovery drive so that the task is completed in a time-bound manner and in keeping with the chief minister's directive," Singh said.

Notices had been sent to all defaulting properties under Section 130 of the Haryana Municipal Corporation Act, 1994, which makes it mandatory for every property owner to pay their taxes and clear arrears. Under the Act, an 18% interest is levied on defaulters annually. Their properties could even be attached, sealed or auctioned.

According to the MCG notice, property owners can have a full interest waiver on dues and 10% rebate on taxes of the ongoing financial year if they pay their dues by January 31.

The office of Today Homes declined comment on the decision to seal its property, saying the company was under insolvency and an IRP had been appointed. Repeated calls to the directors of Universal builders met with the response that they were not reachable.
